Introduction
This Privacy Policy describes how Falcanna ("Falcanna," "we," "us," or "our"), a United States of America company, collects, uses, and shares information from visitors and users of falcanna.com and falcanna.shop (collectively, the "Sites") and any related services, features, or functionality (collectively, the "Services"). By using the Sites or Services, you agree to the terms of this Privacy Policy.
Falcanna operates in Washington State and Oklahoma and serves customers in both states. This policy is designed to comply with the Washington Privacy Act (RCW 19.255) ("WPA"), the Washington My Health My Data Act (RCW 19.373) ("MHMDA"), and the Oklahoma Consumer Data Privacy Act (SB 546, effective January 1, 2027) ("OKCDPA"). Where applicable, your rights under each law are described in this policy.
We may update this policy as our business or applicable law evolves. All updates will be posted on this page with a revised effective date. Continued use of the Sites after any update constitutes your acceptance of the revised policy.
Age Requirement
The Sites and Services are intended solely for individuals who are 21 years of age or older. We do not knowingly collect personal information from anyone under the age of 21. If you believe a minor has provided us with personal information without parental consent, please contact us at admin@falcanna.com and we will take prompt steps to remove that information.
Information We Collect
Information You Provide Directly
We may collect the following information when you interact with our Sites or Services:
- Name
- Email address
- Phone number
- Mailing address
- Any information you submit through our contact form, newsletter sign-up, or SMS opt-in
Information Collected Through falcanna.shop
Our merchandise store at falcanna.shop is fulfilled through Printful, a print-on-demand and fulfillment service. When you place an order, your order and shipping information is transmitted to and processed by Printful to complete your purchase. Payment processing is handled by third-party payment processors. We do not directly collect or store your payment card information. Information collected by Printful and any payment processor is governed by their respective privacy policies, which we encourage you to review independently.
Vendor Portal
Falcanna operates a backend vendor portal that allows licensed dispensary partners to log in and manage wholesale orders. Information collected through the vendor portal is limited to business contact and account credentials necessary to operate that commercial relationship and is not used for consumer marketing purposes.
Information Collected Automatically
When you visit our Sites, we and our third-party service providers may automatically collect:
- IP address and approximate geographic location
- Browser type, version, and device
- Operating system
- Pages visited and time spent on pages
- Referring and exit URLs
- Cookie identifiers and similar tracking technologies
- Information about how you navigate and use the Sites
We limit the personal data we collect to what is adequate, relevant, and reasonably necessary for the purposes disclosed in this policy, consistent with the data minimization requirements of applicable state law.
How We Use Your Information
We use the information we collect to:
- Operate, maintain, and improve the Sites and Services
- Fulfill merchandise orders placed through falcanna.shop
- Send you marketing communications by email or SMS if you have opted in
- Respond to inquiries submitted through our contact form
- Comply with applicable federal, state, and local legal requirements
- Detect and prevent fraud, abuse, or unauthorized access
- Analyze traffic and usage patterns to improve user experience
- Administer the vendor portal and wholesale ordering system
We will not use your information for purposes that are incompatible with the purposes disclosed at the time of collection without first providing you notice and, where required by applicable law, obtaining your consent.
Email and SMS Marketing
If you subscribe to our email list or SMS program, you expressly consent to receiving marketing communications from Falcanna. You may withdraw this consent at any time. To unsubscribe from email communications, click the unsubscribe link in any email we send. To opt out of SMS communications, reply STOP to any message. Standard message and data rates may apply. We will honor all opt-out requests within the timeframe required by applicable law.
Cookies and Tracking Technologies
Our Sites use cookies, pixels, and similar tracking technologies to collect information about how you use the Sites. You may adjust your browser settings to refuse or delete cookies, though doing so may affect the functionality of certain features. We may use Google Analytics or similar third-party analytics tools to help us understand site traffic and usage patterns. These tools collect information about your use of the Sites and transmit it to their servers in accordance with their own privacy policies.
Washington State and Oklahoma residents have the right to opt out of the processing of personal data for targeted advertising. If you wish to exercise this right, please contact us at admin@falcanna.com.
How We Share Your Information
We do not sell your personal information to third parties for monetary consideration.
Service Providers
We may share information with third-party vendors who perform services on our behalf, including Printful for merchandise order fulfillment, email and SMS marketing platform providers, and analytics providers. These parties are contractually obligated to use your information only as necessary to perform the services we have engaged them to provide and may not use it for their own independent purposes.
Legal Requirements
We may disclose your information if required to do so by applicable law, valid legal process, court order, or government or regulatory authority, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
Business Transfers
In the event of a merger, acquisition, reorganization, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will provide notice of any such change by updating this Privacy Policy. Any successor entity will be required to honor the commitments made in this Privacy Policy with respect to information collected prior to the transfer.
With Your Consent
We may share your information with third parties in circumstances not described above when we have obtained your explicit, informed consent to do so.
Your Privacy Rights
Washington State Residents β Washington Privacy Act (RCW 19.255)
As a Washington State resident, you have the following rights with respect to your personal data:
- The right to confirm whether we are processing your personal data and to access that data
- The right to correct inaccuracies in your personal data
- The right to delete personal data you have provided to us or that we have collected about you
- The right to obtain a portable copy of your personal data in a readily usable format
- The right to opt out of the processing of your personal data for targeted advertising
- The right to opt out of the sale of your personal data
- The right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects
To exercise any of these rights, contact us at admin@falcanna.com. We will respond to verified requests within 45 days as required by the WPA. If we decline your request, you may appeal by contacting us at the same address. If your appeal is denied, you may escalate your complaint to the Washington State Attorney General at www.atg.wa.gov.
Oklahoma Residents β Oklahoma Consumer Data Privacy Act (SB 546, effective January 1, 2027)
Beginning January 1, 2027, Oklahoma residents will have the following rights with respect to their personal data under the OKCDPA:
- The right to confirm whether we are processing your personal data and to access that data
- The right to correct inaccuracies in your personal data
- The right to delete personal data you have provided to us or that we have collected about you
- The right to obtain a portable copy of your personal data in a readily usable format
- The right to opt out of the processing of your personal data for targeted advertising
- The right to opt out of the sale of your personal data for monetary consideration
- The right to opt out of profiling in furtherance of decisions that produce significant effects concerning you
To exercise any of these rights, contact us at admin@falcanna.com. We will respond to verified requests within 45 days. If we deny your request, you may appeal within a reasonable period and we will respond to your appeal within 60 days. If your appeal is denied, you may escalate to the Oklahoma Attorney General's online complaint mechanism at www.oag.ok.gov.
Please note that the OKCDPA applies to businesses that process personal data of 100,000 or more Oklahoma consumers annually, or 25,000 or more consumers while deriving over 50% of gross revenue from the sale of personal data. Falcanna may not currently meet these thresholds, but we are committed to honoring these rights regardless.
Sensitive Data
Both Washington State and Oklahoma law require that we obtain your consent before processing sensitive personal data. Sensitive data includes, but is not limited to, data concerning physical or mental health, precise geolocation, biometric data, racial or ethnic origin, religious beliefs, sexual orientation, and citizenship or immigration status.
We do not intentionally collect sensitive data through our Sites. If we determine that any data we collect constitutes sensitive data under applicable law, we will obtain your explicit consent before processing that data for any purpose beyond what is strictly necessary to provide the service you have requested.
Washington My Health My Data Act (RCW 19.373)
Falcanna does not collect, process, or share consumer health data as defined under Washington's My Health My Data Act (RCW 19.373). We do not collect medical records, health history, health-related purchase data used to infer health status, or any other information that identifies a consumer's past, present, or future physical or mental health condition. Accordingly, the substantive obligations of the MHMDA do not currently apply to our data practices.
If our data collection practices change in a way that brings us within the scope of the MHMDA, we will update this policy accordingly and comply with all applicable requirements of the Act, including publishing a standalone Consumer Health Data Privacy Policy as required by RCW 19.373.
Data Retention
We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with applicable legal obligations, resolve disputes, and enforce our agreements. We limit data retention to what is reasonably necessary consistent with the data minimization principles required by applicable state law. When personal data is no longer needed, we will delete or anonymize it. If you request deletion of your data, we will respond within the timeframe required by applicable law. Certain information may be retained in backup or archival storage where immediate deletion is not technically feasible, in which case we will isolate that data from further active processing until deletion is possible.
Third-Party Links
Our Sites may contain links to third-party websites, including dispensary partners, press outlets, and media platforms. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any third-party site you visit through a link on our Sites.
Security
We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction, consistent with the data security requirements of applicable state law. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee the absolute security of your information, and you use the Sites at your own risk. In the event of a data breach that triggers notification obligations under applicable state law, we will provide notice as required.
Transfer of Data
Falcanna is based in Washington State. If you access our Sites from outside the United States, your information may be transferred to, stored, and processed in the United States. Data protection laws in the United States may differ from those in your country of residence. By using our Sites, you consent to the transfer and processing of your information in the United States in accordance with this Privacy Policy.
Governing Law
This Privacy Policy is governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any dispute arising out of or relating to this Privacy Policy or our data practices shall be subject to the exclusive jurisdiction of the state and federal courts located in Washington State. By using our Sites or Services, you consent to personal jurisdiction in Washington State for any such dispute. Nothing in this section limits the rights of Oklahoma residents under the OKCDPA or the rights of Washington residents under the WPA or MHMDA.
Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, applicable law, or for other operational reasons. When we make material changes, we will update the effective date at the top of this policy and, where appropriate, provide additional notice. Your continued use of the Sites after any update constitutes your acceptance of the revised Privacy Policy.
